Information:
We at Connectbrazil.com are pleased to welcome all Brazilian
music fans to our online store and Buyers Club, and we hope
to keep you as a happy and satisfied customer. We provide
this information to help you clearly understand our procedures
and to insure your rights as a customer. The
information on this page is accessible with one click from
any page within our e-store. When
you place an order with Connectbrazil.com, you are agreeing
to accept our terms and conditions as stated and linked below.
Please
contact
us directly if you need a helping hand, or with any questions
or concerns you have. Unlike other web stores, we do not hide
or 'bury' our contact information. Please understand that
we do our best to respond within 24 hours, but sometimes it
may take a little longer.
1.
Eligibility:
Membership to the Connectbrazil.com Buyers Club is open to
Brazilian music fans anywhere in the world. Please note that
you must have a valid credit card to join our club. Acceptance
of these terms is a condition of membership to the Connectbrazil.com
Buyers Club.
2.
Membership:
Membership is offered for one-year and two-year terms, at
a standard rate of US$49.99 and US$79.99 respectively, charged
to your credit card (see 'Payment', below).
The
Connectbrazil.com Buyers Club is designed around the shipment
of our quarterly 'Editor's Choice Seasonal Selections'. All
memberships officially begin on the first day of the next
quarter-year (January 1, April 1, July 1, or October 1) but
new members may enroll anytime to enjoy all of the benefits
and privileges of membership without the application of membership
requirements.
For
example, if your enrollment date is February 2, you'll have
access to all benefits and privileges, including membership
discounts, Free Shipping (below), your '3 For Free' selections
(below) and automatic entry into Members Only contests (below),
but your membership will not officially begin until April
1, when your first of four quarterly 'Seasonal Selections'
will be mailed to you and your requirements of membership
commence.
Membership
is not transferable, and others may not use or have access
to your membership. You are responsible for keeping your account
in good standing, including up-to-date mailing address, telephone
and e-mail address.
2a.
Members outside of the United States (excluding Puerto Rico
and the US Virgin Islands):
Members with delivery addresses outside of the United States
and its territories may participate in all aspects of the
Connectbrazil.com Buyers Club, with amendments to the 'Free
Shipping' benefit. For further details, please refer to the
'Free Shipping' section below.
Please
note that all payments must be made in US dollars. Check with
your bank for a complete understanding of this requirement.
2b.
Renewal:
As we approach the final months of your membership, you will
be sent an 'Automatic Renewal' notice by e-mail. If you do
not cancel your membership with 14 days of this notice, your
membership will be renewed and your credit card will be charged
at the standard renewal rate. A follow-up e-mail will confirm
your renewal and contain instructions on how to receive your
'3 For Free' selections for your next term of membership.
If
you choose not to continue your membership beyond the initial
term, simply contact
us by e-mail within the 14-day 'renewal notice' period.
If,
after ending your membership with our Buyers Club, you decide
to rejoin, please be aware that your new membership fee will
be based on the current standard rate, which may be higher
than your original rate.
Please
note that as of June 1, 2011, our 'forgiveness' program -
which has underwritten unfulfilled membership purchase compliance
in 2009 and 2010 - will end. Members are expected to fulfill
their obligations to the Club.
2c.
Promotional Rates:
From time to time, Connectbrazil.com may offer lower promotional
rates for first-time members. Promotional rates apply to the
initial membership year only and will be offered in the form
of a coupon code, which must be entered during the checkout
process. Connectbrazil.com also uses coupon codes to offer
discounts on items and services. In all cases, discounts will
not be honored after the checkout process has been completed.
Invalid
coupon codes (due to date stamp or other limitations) or inappropriate
use of codes, will not be honored. In such cases, the invalid
discounted amount will be re-billed to your credit card. We
regularly offer special discount incentives for initial membership
to our Connectbrazil.com Buyers Club, with the code BCM-01
and BCM-02 used for one- and two-year membership terms. These
specific codes may be applied to the cost of initial membership
ONLY, and will not be honored for any other items ordered.
3.
Buyers Club Benefits and Privileges:
As a member of the Connectbrazil.com Buyers Club, your benefits
and privileges include: 1) Discounts of up to 25% or more
on every order. Please note that extremely rare items and
used items may or may not offer a membership discount. 2)
'Free Shipping' on all 3 CD orders. 3) Annual '3 For Free'
selections. 4) 'Preferred Processing'. 5) Automatic enrollment
in 'Members Only' contests and 5) Special offers and incentives
not available to nonmembers.
We
will be adding additional member benefits as we go forward.
3a.
3 For Free:
Members are entitled to select three '3 For Free' CDs from
our Connectbrazil.com e-store. To browse
our current catalog of '3 For Free' selections, please
go to the navigation bar at the top of any page at Connectbrazil.com
and click on 'Membership'. Then, click on the 'Three For Free'
tab.
Our
inventory for '3 For Free' selections varies from title to
title and with new members joining our Buyers Club every day,
please be aware that all of our '3 For Free' selections are
offered on a 'first come, first served' basis. Because of
this, we may sometimes be 'out of stock' on a '3 For Free'
title, even though it might still be listed on our website.
If
inventory on any '3 For Free' CD is depleted, we will contact
you with a list of alternative suggestions to help you complete
your '3 For Free' selection process.
Please
note that you cannot select your '3 For Free' CDs until you
have successfully enrolled as a member of the Connectbrazil.com
Buyers Club.
All
'3 For Free' selections are shipped separately and are subject
to regular shipping and handling for USPS Media Mail or Priority
Mail delivery in the US. This means that if you combine your
'3 For Free' selections with other items in the same order,
you will be billed a second shipping and handling charge for
your '3 For Free' selections.
While
order processing for regular Connectbrazil.com orders is 3-4
days, the processing time for '3 For Free selections is longer.
Please allow 10-14 days for processing and shipment of '3
For Free' selections.
3b.
Contests:
Members are automatically enrolled in all contests for prizes
ranging from CDs, CD/DVD collections, Concert tickets and
entertainment packages including Brazilian restaurants and
trips to Brazil.
Members
are contacted by e-mail and by telephone, and in the case
of major prizes, by certified letter. Some contests may include
a deadline for receipt of a prize and require a response from
a named contestant. Always carefully read the rules for all
contests and promotions at Connectbrazil.com.
Local,
State and Federal taxes are the responsibility of the winner.
Employees,
active clients and partners of The Montage Communications
Group, Inc., The Sounds of Brazil radio show and Connectbrazil.com
are not eligible.
3c.
Free Shipping:
Buyers Club members with United States delivery addresses
(including Alaska, Hawaii, Puerto Rico and the US Virgin Islands)
will automatically receive 'Free Shipping' on all 'three CD'
orders from Connectbrazil.com.
The
following rules and restrictions apply to Connectbrazil.com
'Free Shipping':
1).
You must be a current and active member in the Connectbrazil.com
Buyers Club to be eligible.
2).
A 'Free Shipping' order must consist of three CDs only.
A double CD constitutes two CDs, not one. DVDs, books,
VHS tapes, CD box sets and other items do not apply.
3).
You may not combine orders to receive 'Free Shipping'.
Your 'three CD' selections must be submitted to us and
then mailed as a single order to the same destination
address. Backordered items may delay the processing of
your order for shipping.
4).
All 'Free Shipping' orders will be sent by USPS Media
Mail only. Please select 'Priority Mail' delivery if you
require faster delivery to your US address. A charge of
US$7.49 will apply to all 'three CD' orders delivered
by Priority Mail.
5).
Members with delivery addresses outside of the United
States will be charged their country's specified rate
for USPS airmail package delivery, plus a service charge
of $US2.50.
6).
'Free Shipping' does not include USPS Delivery Confirmation.
You may add this service by typing "Delivery Confirmation
requested" in the 'Special Instructions' text box
on the order form before you submit your order. Sorry,
this cannot be added to your order once it has been submitted.
Cost for 'Delivery Confirmation' is US$1.50 and applies
to US delivery addresses only.
7).
'3 For Free' and 'Seasonal Selections' are not available
for 'Free Shipping'.
Connectbrazil.com
utilizes the services of the US Post Office for domestic and
international delivery. The USPS regularly modifies both its
category and pricing structure. Because our shipping rates
are based solely on USPS rates (which are subject to change
without notice), a USPS surcharge is added to each shipment
to reflect current USPS rate policy.
3d.
Preferred Processing:
'Preferred Processing' brings Buyers Club members to the front
of the line. Members will always have their orders filled
before nonmembers, as well as priority access to inventory
for hard-to-find and 'low stock' items, and back order fulfillment.
Additionally,
Members will benefit from 'first notice' e-mail offers, limited
availability items and pre-order fulfillment, too.
4.
Buyers Club Requirements:
When joining or renewing with the Connectbrazil.com Buyers
Club, you agree to purchase a minimum of eight (8) 'new' selections
from our e-store during your annual term. Selections can be
made from CDs, DVD, VHS videos, books or other items, plus
any special offers or incentives promoted to members. 'Special
offer' items and items marked as 'Used' will not apply to
your annual minimum. Two-year memberships require a minimum
purchase of 16 items during the term.
Additionally,
members will be automatically sent four (4) quarterly 'Editor's
Choice Seasonal Selections' per membership year. 'Seasonal
Selections' can not be applied to your minimum selection total.
Credits:
If
you have not met your minimum selection total by the 1st day
of the final month of your membership, you may be sent a reminder
notice by email. However, it is your responsibility to track
your required purchases. We will provide order history and
advice when requested by phone or email.
If
you have not met your minimum selection total by your renewal
date Connectbrazil.com will charge your credit card a fee
of $19.99 for each item not purchased as part of the minimum
requirement, and send you a credit voucher for the quantity
(not the dollar amount) of the items outstanding to properly
conclude the requirements of the term. If the price of the
item exceeds $19.99, your credit for that single item may
be applied as a dollar amount, and you will be responsible
for the remaining amount of the item.
Here
are two examples:
1.
Using your credit to purchase a CD priced at 19.99 or less:
In
this case, the credit will be applied as a quantity credit.
Your annual membership requires the purchase of a minimum
number of eight items (16 items for a two year membership).
If you did not purchase any items during your membership year,
your credit would be for eight items. In this example, this
CD would cost you one of your eight credits.
2.
Using your credit to purchase an item priced at $20.00 or
more:
In
this case your credit will be applied as a dollar amount of
$19.99. You will be charged a balancing sum for items priced
higher than $19.99.
Quantity
credits will be valid for in-stock items only. Dollar amount
credits may also be applied to out-of-stock items (if available)
and special orders. All credits are valid for 120 days from
date of issue and do not apply to shipping and handling charges,
taxes, renewal fees or for the purchase requirements of your
current membership term.
The
above policy also applies to early termination of membership.
We do not charge an 'early termination' fee. There are no
refunds on costs related to membership.
4a.
Seasonal Selections:
Once every calendar quarter, members will automatically receive
our 'Editor's Choice Seasonal Selection' as part of their
Buyers Club requirement. Members will be sent four (4) quarterly
selections per one-year term.
Our
'Seasonal Selections' are carefully chosen for your enjoyment
and appreciation of Brazilian music. They are always offered
at the lowest possible 'Members Only' price.
If
a particular 'Seasonal Selection' does not meet with your
approval for any reason, just notify
us by e-mail. Be sure to include your name, your address
and the title of the item in question. Connectbrazil.com will
issue you a credit voucher for US$10.00, which can be applied
to any future purchase and you may keep the 'Seasonal Selection'.
'Seasonal
Selections' are a part of your membership requirement, and
are not subject to return, refund or exchange, except for
replacement due to manufacturer's defect. Our US$10.00 credit
voucher guarantee is limited to two (2) 'Seasonal Selections'
per membership year. Repeated and/or frequent requests for
this guarantee may result in denial of claim and/or removal
from the Connectbrazil.com Buyers Club.
4b.
Payment:
Payment for membership to the Connectbrazil.com Buyers Club
and all related purchases, including 'Seasonal Selections'
(below), is accepted in US dollars only, by a valid credit
card only, as approved by our licensed credit verification
provider, Authorize.net.
In
the event that a credit card payment is not approved, we may,
at our discretion, require a deposit or other form of advance
payment based on our evaluation of your credit, or we may
terminate your membership immediately if you fail to make
payments as required. We may also charge late fees and penalties
if a pattern of delayed payment emerges.
Personal
checks/money orders/certified checks/bank checks may be accepted
for total payment of required purchases in advance, plus shipping
and handling, and a convenience fee of $15.00. Please contact
us for details. COD's are not accepted.
4c.
Recurring charges:
Once each quarter, a recurring charge for the 'Editors Choice
Seasonal Selection' (below) will appear on your credit card
statement, listed from Connectbrazil.com. This charge will
reflect the purchase price of the 'Seasonal Selection' plus
regular shipping & handling charges for delivery by USPS
Media Mail.
Your
membership will automatically renew during the final month
of your membership term and your credit card will be charged
a renewal fee based on the standard rate. Please see 'Renewal',
above for further information.
Please
note that if you do not place an order within any 90-day period,
we may not be able to process your recurring charge, therefore
all members must provide up to date payment information when
requested.
Your
acceptance of these terms will constitute your authorization
for the recurring charges as defined in this section. Connectbrazil.com
will not use recurring charges to your credit card for any
other purpose without your prior, written approval.
5.
Notice:
Acceptance of these terms is a condition of membership to
the Connectbrazil.com Buyers Club.
These
terms and conditions may change without prior notice. Members
will be notified of amended versions on the Members
Page at Connectbrazil.com. Connectbrazil.com assumes no
responsibility for errors, omissions in this document. If
you are in doubt about the validity of any part of this document,
you may request an official written copy by clicking here.
